Terms of Service

By accessing or using comicly.app, you agree to comply with these terms and all applicable laws. If you do not agree, do not use the service.

You are responsible for keeping your account credentials secure and for all activity under your account.

We may suspend or restrict access if we detect abuse, fraud, unlawful usage, or violations of these terms.

Subscriptions renew automatically unless cancelled before the next billing cycle. One-time credit packs are billed once at checkout.

Taxes, payment processing, and billing compliance may be handled through Waffo Pancake as our Merchant of Record partner.

You may not use the service to generate illegal, infringing, harmful, or abusive content, or to violate third-party rights.

We reserve the right to investigate misuse and remove access, generations, or balances associated with abusive activity.

Because comicly.app provides AI image and comic generation, you may not use the service to create, upload, or distribute any of the following categories of content:

1. Sexual or NSFW content, including pornographic, sexually explicit, or sexually suggestive material.

2. Violence and gore, including graphic depictions of violence, torture, self-harm, or content that glorifies or incites harm.

3. Hate speech, including content that attacks, demeans, or incites discrimination against people based on race, ethnicity, religion, gender, sexual orientation, disability, or similar protected characteristics.

4. Child-unsafe content, including any sexualized, exploitative, or otherwise harmful depiction of minors, in any style or form.

5. Deepfakes and impersonation, including realistic depictions of real people without their consent, or content designed to deceive others about a person's identity, words, or actions.

6. Copyright or trademark infringement, including content that copies protected characters, artworks, logos, or brands without authorization, or that otherwise violates third-party intellectual property rights.

Enforcement: if we detect or confirm a violation, we may remove the content, withhold or revoke credits, suspend or terminate the account, and report illegal content to the relevant authorities where required by law. Repeated or severe violations lead to permanent account termination without refund.

Reporting: anyone can report suspected violating content by emailing [email protected] with the content link or ID and a short description. We review every report and aim to respond within a reasonable timeframe.

Moderation: we combine automated safety filters on prompts and generated output with manual review of reported content. We may also block or refine prompts that attempt to bypass these safeguards, and we continuously update our filters as new abuse patterns emerge.

Subject to these Terms, you may use the comics and images you generate with Comicly ("Outputs") for personal and commercial purposes, including publishing, marketing, advertising and merchandise. Comicly does not claim ownership of your Outputs. As between you and Comicly, you keep whatever rights you hold in your Outputs and in the prompts and images you provide ("Inputs"), to the extent permitted by applicable law.

You are solely responsible for your Inputs and Outputs and for how you use them. You must not create or use Outputs that infringe or misappropriate any third party's intellectual property, publicity or privacy rights, or that violate any law. You must also not imply that your Outputs are endorsed by any person or brand without permission.

Outputs are produced by third-party AI models. Your use of Outputs is also subject to the usage policies and terms of those model providers, and you agree to comply with them. Because AI-generated content may not be unique, similar outputs may be generated for other users, and Comicly makes no guarantee that any Output is eligible for copyright protection or free of third-party claims.

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated output may be inaccurate, unexpected, or unsuitable for your intended use, and you are responsible for reviewing generated content before publishing it.

To the maximum extent permitted by law, comicly.app is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service. Our total aggregate liability for any claim is limited to the amount you paid to us in the twelve months preceding the claim.

We are not responsible for interruptions, delays, or failures caused by events beyond our reasonable control, including third-party model or infrastructure provider outages, network failures, or force majeure events.
